A man is facing charges after Gates Police say he broke into a dead woman's motel room, took pictures of her body, stole her dog and her phone, and left without telling anyone she had died.

A man is facing charges after Gates Police say he broke into a dead woman's motel room, took pictures of her body, stole her dog, and left without telling anyone she had died.

On Oct. 23, Gates Police responded to Motel 6 on Buell Road for a 30-year-old woman who had died of a drug overdose.

Officers say the investigators led them to 35-year-old Jose Pena, who knew the victim. Investigators say Pena went to the motel room and broke in through a window when no one answered the door.

Pena then allegedly took pictures of her body and stole her phone and dog.

Officers say Pena never told anyone that the woman died. Housekeeping discovered her body on Oct. 23 and called police.

Pena was arrested on Dec. 6 and charged with burglary, petit larceny, and tampering with physical evidence. He was remanded to the Monroe County Jail on $3,000 cash or $6,000 bond.

The dog was recovered and returned to the victim's family.
