A drug dealer who is no stranger to the criminal system was sentenced to five-years in state prison after he pled guilty to third degree criminal sale of a controlled substance
CANANDAIGUA — A Wayne County man was sentenced in Ontario County Court to 5-years in state prison after pleading guilty to drug charges.
On Wednesday in Ontario County Court Torey Smith, 30, was sentenced by Ontario County court Judge Kristina Karle to 5 years in state prison plus 2 years of post release supervision for two counts of third degree criminal sale of a controlled substance .
Prior to sentencing smith asked for mercy of the court.
“Have mercy on my behalf on all that transpired,” said Smith at the time of sentencing. “I’m requesting the mercy of the court of four and three.”
Smith is referring to the request made on his behalf by his newly appointed attorney, Robert Zimmerman of four years in state prison instead of five years.
Judge Karle did not waver from the agreed upon sentence despite Smith’s plea. Smith was sentenced as a second felony offender.
In addition to the prison sentence Smith will forfeit $1,400 in restitution, $569 of which was taken at the time of arrest.
Smith still has pending legal matters in Wayne County.
